The Advance Pricing Agreement scheme has suffered considerable changes in the last year, due to negotiations between the Tax authorities of Mexico and the U.S., which has prompted each authority to make changes in their corresponding tax systems.

    3. The SAT released the platform and digital formats for the submission of the new Related Parties Annual Informative Returns

    Alert 41.2017

    15 Nov 2017

The SAT released the platform and digital formats for the submission of the new Related Parties Annual Informative Returns

    Alert 41. 2017

In line with our previous Alert 39, as a result of the joint work between the Mexican Tax Authority, Servicio de Administración Tributaria (hereinafter SAT) and the Taxpayers Advocacy Agency´s, Procuraduría de la Defensa del Contribuyente (hereinafter PRODECON), the platform and digital formats for the submission of the of the Related Parties Annual Informative Returns: Master, Local and Country by Country, have been released.

As of November 1st, taxpayers who are required to submit such informative returns can now access the portal within the SAT's official website and proceed with their filling, being the deadline to comply with this obligation, December 31st, 2017.

It is worth to mention that the SAT's official website also includes other complementary elements such as the multilateral agreement for the exchange of country by country reports, as well as the guide formats and frequently asked questions.

PRODECON will continue to attend any doubt or problem that the taxpayers may have during the filling of the new Informative Returns. Also, after having tested the platform together with large taxpayers, the opinions of PRODECON and the representatives of the companies indicate that the platform is friendly, practical and that it is limited to request the information that the Organization for Economic Cooperation and Development (OECD) expressed within the framework of Action 13 of the BEPS Plan.

Finally, the, SAT informed that with the issuance of the technological platform to comply with the obligation set in Article 76-A of the Mexican Income Tax Law, the implementation of Action 13 of the BEPS plan in Mexico is considered as completed.
